On April 11, the Cyberspace Administration of China (CAC) released the Administrative Measures for Generative Artificial Intelligence Services (Draft for Comment) (the "Draft"), which is open for public comments until May 10, 2023.
According to the Draft, organizations and individuals that use generative artificial intelligence (AI) products to provide services such as chats and texts, images, and sound generation (hereinafter the "providers"), including those who support others in generating texts, images, sounds, etc. via programmable interfaces, are responsible for the content generated by the products; if personal information is involved, the providers shall fulfill the statutory obligations of personal information processor and protect personal information. The Draft further states that the providers must be responsible for the legality of the pre-training data and optimized training data sources of generative AI products. The pre-training and optimized training data used for generative AI products should meet five requirements including "compliance with the requirements of the Cybersecurity Law of the People's Republic of China and other laws and regulations."
